BORGAS Asset Creator / Order policies
License agreement.

This agreement is between you and Devin Tague, doing business as BORGAS, of Massachusetts, USA ("BORGAS", "we"). It covers BORGAS Asset Creator, including its installer, updates and documentation (the "Software"). By installing, activating or using the Software you agree to these terms. If you don't agree, don't install or use it, and see the refund policy.
1. Your license
When you buy a license, BORGAS grants you a personal, non-exclusive, non-transferable license to install and use the Software for any lawful purpose, including commercial work, subject to these terms.
- One person. A license is for one named person. You may install the Software on computers you personally use, but only you may use it.
- Updates. Your license includes updates to version 1.x of the Software released by BORGAS. BORGAS may charge for a future major version (2.0 and later); you can keep using the version you have.
- License key. Your license key is for you only. Don't share, publish or resell it. BORGAS may revoke a key that is shared publicly, bought fraudulently, refunded or charged back. When online, the Software checks a list of revoked keys published by BORGAS and stops paid features for a revoked key.
2. What you may not do
You may not: (a) share, rent, lend, resell or sublicense the Software or your license key; (b) remove or bypass the license check or other protections; (c) reverse engineer or modify the Software except where the law expressly allows it despite this restriction; (d) use the Software to break the law or to infringe anyone else's rights.
3. What you make is yours
The 3D models, textures, rigs and other files you create with the Software ("Your Content") belong to you. BORGAS claims no ownership of Your Content and does not receive copies of it. You're responsible for having the rights to the reference images you use and for how you use Your Content.
4. Third-party components and AI models
The Software uses open-source software and AI models made by others, including Microsoft TRELLIS.2, the LocalMesh engine, Meta's DINOv3 and Blender. Each keeps its own license, listed in the Software's third-party notices. Some models are downloaded directly by you from their publishers during setup, under the publisher's terms (for example, Meta's DINOv3 license, which you accept on Hugging Face). You agree to follow those terms.
5. Your data
The Software runs on your computer. Your reference images, projects and generated models stay on your computer; BORGAS doesn't collect them. Setup downloads the engine and models from their publishers. Once a day, when online, the Software downloads BORGAS's public list of revoked license keys from borgas.us. When you check for updates, it downloads release information and installers from updates.borgas.us. These requests send no personal data or projects. See the privacy policy.
6. No warranty
AI-generated results vary and may contain errors (for example holes, artifacts or imperfect rigs). The Software is provided "as is", without warranties of any kind, express or implied, including fitness for a particular purpose, to the extent the law allows. BORGAS doesn't guarantee that the Software will run on every computer or that every result will be usable. Your rights under the refund policy still apply.
7. Limit of liability
To the extent the law allows, BORGAS is not liable for indirect, incidental or consequential damages, or for lost profits, data or work, arising from the Software. BORGAS's total liability for any claim is limited to the amount you paid for your license.
8. Ending this agreement
This agreement lasts until it ends. It ends automatically if you break it, or if your purchase is refunded or charged back. When it ends, stop using the Software and uninstall it. Sections 3, 6, 7 and 9 continue after it ends.
9. General
This agreement is governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. If part of it can't be enforced, the rest still applies. This agreement, the refund policy and any written terms on your license make up the whole agreement about the Software. BORGAS may update these terms for future versions; the version you accepted applies to your copy.
